Standards and laws that regulate Electronic Data Interchange (EDI) in healthcare
Electronic Data Interchange (EDI) in healthcare is regulated by various laws, standards, and organizations to ensure the security, privacy, and interoperability of health information. Here are some of the key regulations and initiatives that govern EDI in the healthcare industry:
- Health Insurance Portability and Accountability Act (HIPAA): HIPAA includes provisions for the privacy and security of health information, known as the Privacy Rule and the Security Rule, respectively. The Privacy Rule establishes national standards for the protection of individually identifiable health information, while the Security Rule sets standards for the electronic storage, transmission, and handling of health information.
- Health Information Technology for Economic and Clinical Health (HITECH) Act: The HITECH Act promotes the adoption and meaningful use of electronic health records (EHRs) and sets requirements for healthcare organizations to protect patient information and report breaches of unsecured protected health information (PHI).
- Centers for Medicare and Medicaid Services (CMS) initiatives: CMS has implemented several programs, such as the Electronic Health Record (EHR) Incentive Programs and the Medicare Access and CHIP Reauthorization Act (MACRA), to encourage the adoption and interoperability of electronic health records and electronic exchange of health information.
- X12 Standards: X12 is a set of electronic data interchange standards developed by the Accredited Standards Committee (ASC) X12. These standards define the format and content of EDI transactions in healthcare, including those related to claims, eligibility inquiries, remittance advice, and more.
- National Council for Prescription Drug Programs (NCPDP): NCPDP is an industry standards development organization that creates standards for the exchange of pharmacy-related information, including electronic prescriptions, pharmacy claims, and medication history.
- Health Level Seven (HL7): HL7 is another standards development organization that focuses on the exchange, integration, sharing, and retrieval of electronic health information. HL7 standards enable the interoperability of healthcare systems and support the exchange of clinical and administrative data.
In addition to these regulations and standards, healthcare organizations must also comply with state and local laws, as well as contractual agreements with business associates, to ensure the secure and compliant exchange of electronic health information.
